These Terms of Service ("Terms") govern your access to and use of the PingMyService website and services (the "Service") operated by GPJDG, a company registered in Poland, EU VAT ID: PL9552569731("we", "our", or "us"). By using the Service, you agree to be bound by these Terms.
1. Description of the Service
PingMyService provides online monitoring services to perform periodic checks — including HTTP, HTTPS, ICMP (ping), TCP, and UDP — on endpoints specified by you ("Checks"). These Checks are run at configurable intervals and are designed to alert you to downtime, latency, or connectivity issues with your services.
2. User Accounts
To access the Service, you must register an account. You agree to provide truthful and accurate information and to keep your account data updated. You are responsible for the confidentiality of your login credentials and all activity under your account.
3. Billing and Payments
- Stripe Integration: All billing is securely handled through Stripe. By adding your payment method, you authorize GPJDG to charge your card automatically for all applicable fees.
- Flat Creation Fee: A non-refundable flat fee of $1 USD will be charged for each Check created, regardless of its active duration or deletion.
- Usage-Based Billing: In addition to the flat fee, you will be billed based on the current pricing table available on our website.
- Automatic Charges: Payments are processed automatically via your saved Stripe payment method.
- No Refunds: All fees are non-refundable, including charges for Checks that are deleted shortly after creation.
4. Check Management
You can create, pause, or delete Checks at any time. Deleting a Check stops future usage-based charges for that specific Check but does not reverse the $1 creation fee already charged.
5. Acceptable Use
You agree to:
- Only monitor endpoints you own or have permission to monitor.
- Not use PingMyService for illegal, abusive, or harmful purposes.
- Avoid overloading the system or disrupting service availability for others.
6. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any violation of these Terms or suspected abuse. You may terminate your account at any time via your dashboard. Termination does not entitle you to refunds for any prior charges.
7. Modifications to Service or Terms
We reserve the right to change or discontinue any aspect of the Service and to update these Terms at any time. You will be notified of significant changes via email or through the Service. Continued use after such changes constitutes acceptance of the revised Terms.
8. Limitation of Liability
To the fullest extent permitted by applicable law, GPJDG and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or service availability, even if advised of the possibility of such damages. The Service is provided “as is” and “as available” without warranties of any kind, either express or implied.
9. Privacy
Your use of the Service is also subject to our Privacy Policy, which describes how your data is collected, stored, and processed.
10. Governing Law
These Terms are governed by and interpreted in accordance with the laws of Poland, without regard to conflict of law principles. All disputes will be resolved in the courts of Poland.
